The Mediation Process
Under Massachusetts law, mediation is not a mandatory component of the divorce process. Nevertheless, the courts strongly encourage it for its numerous benefits, including reduced conflict, cost savings, and greater control over the outcome.
The mediation process typically begins with an initial meeting where the mediator explains the process and rules. The parties then present their views and the issues they wish to resolve. The mediator helps the parties to communicate effectively, identify their interests, generate options, and negotiate a resolution.
